This privacy policy applies to the Counts platform

This privacy policy (“Policy”) explains our policy regarding the collection, use, disclosure, and transfer of your information, personal or otherwise, by Metabook Technologies Private Limited or any of its affiliate(s) (“we” or “us” or “our”), which operates the website ("Site"), “Counts App” (the “App”) available on Google Play Store, iOS and other similar platforms and other Services. The App and the Site are jointly referred to as “Platforms” and individually as “Platform”).

The terms “you” and “your” refer to the user of the Platforms. The term “Service(s)” refers to any Service offered by us on our platforms or otherwise and would include any other future services we may provide or propose to provide.

As we update, improve and expand the Services, this Policy may change, so please refer back to it periodically. By accessing the Platforms or otherwise using the Services, you expressly and fully consent to the collection, storage, transfer, and/or use of the personal information you provide (including any changes thereto as provided by you from time to time) for any of the services offered by us or any of our group entities, or affiliates, in accordance with this privacy policy.

We recognize the importance of maintaining your privacy. We value your privacy and appreciate your trust in us. This Policy applies to current and former visitors to our Platforms and to our online customers. By visiting and/or using our Services, you agree to this Policy. If you do not agree with any term in this Policy, please do not use/avail of our Services.

Information we collect

Contact information. We might collect your name, email, mobile number, device id [IMEI No.], phone number, street, city, state, Pincode, country, IP address, GSTIN, or such other personal identification information. Additionally, we might request you to share your bank account details or other payment-related information either for sending or receiving payments.

Information you post. We collect the information you post on our Platforms regarding issues, feature requests, etc.

Demographic information. We may collect demographic information about you, products you like, add-ons/software/modules or solutions you intend to order or try, add-ons you buy, or any other information provided by you during the use of our Services. We might collect this as a part of a survey or promotion also.

Other information. If you use our Platform, we may collect information about your IP address and the browser you are using. We might look at what site you came from, the duration of time spent on our website, pages accessed, or what site you visit when you leave us. We might also collect the type of mobile device you are using, or the version of the operating system your computer or device is running.

Any information provided by you will not be considered as personal information if it is freely available and/or accessible in the public domain or is not deemed as personal information under the applicable law. Further, any reviews, comments, messages, blogs posted/uploaded/conveyed/communicated by you on the public sections of the Platform or an application store (like the App Store or Play Store) becomes published content and is not considered as personal information which is subject to this Policy. In case you choose to decline to submit information on our Platform, we may not be able to provide certain services on the Platform to you. We will make reasonable efforts to notify you of the same at the appropriate time. In any case, we will not be liable and or responsible for the denial of certain services to you due to not receiving necessary information from you.

Ways in which we collect information

We collect information directly from you. We collect information if you post a comment on our Platforms, websites or ask us a question through phone or email.

We collect information from you passively. We use tracking tools like Google Analytics, Google Webmaster, browser cookies and web beacons for collecting information about your usage of our Platform.

Use of your personal information

We use information to contact you. We might use the information you provide to contact you.

We use information to respond to your requests or questions. We might use your information to confirm your order or purchase or specification for your typical need(s).

We use information to improve our products and services. We might use your information to customize your experience with us. This could include displaying content based upon your preferences.

We use information to look at Platform trends and customer interests. We may use your information to make our Platforms and products better. We may combine information we get from you with information about you we get from third parties.

We use information for marketing purposes. We might send you information about special promotions or offers. We might also tell you about new features or products. These might be our own offers or products.

We use information to send you transactional communications. We might send you emails or SMS or GCM notification about your account.

Sharing of information with third-parties

We may transfer / share information (personal and non-personal) provided to us by you with another Count’s group / corporate entities or affiliates, to the extent required for the purposes of (i) providing you with the Services on the Platforms or for the purposes of developing and providing you with new services, products and/or new applications which may be developed by us, our group entities or our affiliates, (ii) our internal business and/or administrative purposes, and/or (iii) general corporate operations and to any third-party service providers including marketing partners, and you hereby consent to the same. We will take reasonable steps to ensure that these third-party service providers are obligated to protect your personal information and are also subject to appropriate confidentiality/non-disclosure obligations and they comply with the applicable provisions of the data protection laws.

Please note, information collected from you may be processed in or accessed from India or jurisdictions outside of India by members of group entities and categories of third-parties in a jurisdiction that do not have equivalent data protection laws to those in India for the purpose outlined above. These group entities and affiliates with whom such information is shared may market to you as a result of such sharing unless you explicitly opt-out.

Further, we may share the information provided to us by you with third parties such as Counts group entities, affiliates, service providers, customers, or business partners. This may be done in order to provide you access to Services and products offered by us; to collect payments from you; to facilitate our marketing and advertising activities; to comply with our legal obligations etc.

We may share information if we think we have to in order to comply with the law or to protect ourselves. We will share information to respond to a court order or subpoena. We may also share it if a government agency or investigatory body requests as per law. Or we might also share information when we are investigating potential fraud.

In the event that we are involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of our assets, your information may be transferred or disclosed in connection with such business transactions.

We may share your information for reasons not described in this Policy. We will tell you before we do this.

You can opt-out of receiving our marketing emails. Even if you opt out of getting marketing messages, we will still be sending you transactional messages through email and SMS about your purchases or orders.

Third party sites

If you click on one of the links to third party websites, including links to websites or applications of Counts group entities or affiliates, you may be taken to websites or applications we do not control. This Policy does not apply to the privacy practices of those websites. Read the privacy policy of other websites carefully. We are not responsible for these third party sites.

Accessing and updating personal information

When you use the Platform, we make good faith efforts to provide you, as and when requested by you, with access to your information and shall further ensure that any personal information or sensitive personal data or other information found to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such personal information or sensitive personal data or information to be retained by law or for legitimate business purposes. We ask you to identify yourself and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case, where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

Information storage and backup

From time to time, we take backup of your data. This is done to provide you reliable service in case of any data loss.

We shall keep your information in our records till the period of time where we can potentially offer our Services. After such a period of time where our Services are no more relevant to you, we remove all the information pertaining to you from our records.

Information security

We take appropriate security measures to protect against unauthorized access to or alteration, disclosure or destruction of data including accidental or intentional manipulation, loss from access by unauthorised parties. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. All information gathered on our platform is securely stored within the controlled database. Access to the servers is password-protected and is strictly limited.

Our security measures are regularly reviewed and updated to reflect technological developments. Regardless of where your personal information is transferred or stored, we take all steps reasonably necessary to ensure that personal information is kept secure, however, please understand that no transmission of data over the internet or any other public network can be guaranteed to be 100% (one hundred percent) secure.

We seek to ensure compliance with the requirements of the applicable data protection laws to ensure the protection and preservation of your privacy and personal information. We have physical, electronic, and procedural safeguards that comply with the laws prevalent in specific jurisdiction to protect your personal information. By accepting the terms of this Policy, you agree that the standards and practices being implemented by us, are reasonable and sufficient for the protection of your personal information.

We will contact you regarding any breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal information to you via email or any other feasible manner in the most expedient time possible and without unreasonable delay, insofar as consistent with the legitimate needs of law enforcement and will undertake all measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

You can revoke your consent to the processing of your personal information at any time with effect for the future. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal information where such collection, use and disclose without consent is permitted or required under applicable laws.

Updates to this Policy

This Policy was last updated on 15thAugust, 2022. From time to time we may change our privacy practices. We will notify you of any material changes to this Policy as required by law. We will also post an updated copy on our website. Please check our Platforms periodically for updates.

Jurisdiction

If you choose to visit the Platform, your visit and any dispute over privacy are subject to this Policy and the Platform terms of use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India.

In case any personal information is shared by you with us, which is not requested by us during registration, (whether mandatory or optional), we will not be liable for any information security breach or disclosure in relation to such information. Metabook Technologies Private Limited. and its suppliers disclaim all warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, with regard to all products & services developed, provided and marketed by counts mentioned on this site or affiliate sites or their associates and the provision of or failure to provide support services.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall Metabook Technologies Private Limited or its suppliers, resellers, partners be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use products or services provided or marketed by Counts or the provision of or failure to provide any support services, even if Counts has been advised of the possibility of such damages.

These have only been mentioned on this site to demonstrate or support the use of these products or services in conjunction with products or services provided or marketed by Metabook Technologies Private Limited.
